HIV-positive man receives 35 years for spitting on Dallas police officer

Category : Uncategorized

Sunday, May 18, 2008

An HIV-positive man was sentenced to 35 years in prison Wednesday, one day after being convicted of harassment of a public servant for spitting into the eye and open mouth of a Dallas, Texas police officer in May 2006. The United States Centers for Disease Control and Prevention says that no one has ever contracted HIV from saliva, and a gay-rights and AIDS advocacy group called the sentence excessive.

A Dallas County jury concluded that Willie Campbell’s act of spitting on policeman Dan Waller in 2006 constituted the use of his saliva as a deadly weapon. The incident occurred while Campbell, 42, was resisting arrest while being taken into custody for public intoxication.

“He turns and spits. He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with,” said Waller to The Dallas Morning News.

Officer Waller responded after a bystander reported seeing an unconscious male lying outside a building. Dallas County prosecutors stated that Campbell attempted to fight paramedics and kicked the police officer who arrested him for public intoxication.

It’s been 25 years since the virus was identified, but there are still lots of fears.

Prosecutors said that Campbell yelled that he was innocent during the trial, and claimed a police officer was lying. Campbell’s lawyer Russell Heinrichs said that because he had a history of convictions including similarly attacking two other police officers, biting inmates, and other offenses, he was indicted under a habitual offender statute. The statute increased his minimum sentence to 25 years in prison. Because the jury ruled that Campbell’s saliva was used as a deadly weapon, he will not be eligible for parole until completing at least half his sentence.

If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.

The organization Lambda Legal (Lambda Legal Defense and Education Fund), which advocates for individuals living with HIV, says that saliva should not be considered a deadly weapon. Bebe Anderson, the HIV projects director at Lambda Legal, spoke with The Dallas Morning News about the sentence. “It’s been 25 years since the virus was identified, but there are still lots of fears,” said Anderson.

The Dallas County prosecutor who handled the trial, Jenni Morse, said that the deadly weapon finding was justified. “No matter how minuscule, there is some risk. That means there is the possibility of causing serious bodily injury or death,” said Morse. Dallas County District Attorney Craig Watkins stated: “If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.”

Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.

A page at the CDC’s website, HIV and Its Transmission, states: “HIV has been found in saliva and tears in very low quantities from some AIDS patients.” The subsection “Saliva, Tears, and Sweat” concludes that: “Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.” On Friday the Dallas County Health Department released a statement explaining that HIV is most commonly spread through sexual contact, sharing needles, or transfusion from an infected blood product.

93-year-old Michigan man freezes to death after electric company limits his power usage

Category : Uncategorized

Wednesday, January 28, 2009

Marvin Schur, a 93-year-old man from Bay City, Michigan has died after the electric company limited his electric use due to his failure to pay over US$1,000 in past-due payments.

Bay City Electric Light & Power installed a power-limiting device on his home on January 13. The device would limit the amount of power the resident uses and would essentially shut it off if that limit is reached, or if the resident fails to pay the outstanding bill within 10 days of installation. In order for the electricity to be turned back on, the limiter must be reset by pushing a button.

Bay City power says that a warning, indicating that the power was to be turned off and a limiter installed, had been placed on Schur’s front door. Despite that, the company says that they are now “looking at our website and possibly doing an automated phone message. We obviously need to get the word out.”

The autopsy performed on Schur’s body concluded that he had died “a slow, painful death” caused by hypothermia. Dr. Kanu Virani, who performed the autopsy, explained: “Hypothermia shuts the whole system down, slowly. It’s not easy to die from hypothermia without first realizing your fingers and toes feel like they’re burning.”

It was less than 32 degrees Fahrenheit (0 Centigrade) in Schur’s home when neighbors found Schur dead on January 17. Virani commented that it was his first time performing an autopsy on a body in which “the person froze to death indoors.”

“His furnace was not running – the insides of his windows were full of ice the morning we found him,” said George A. Pauwels Jr., who was with his wife when they found Schur’s body.

In Michigan it is illegal for a utility company to disconnect power to any home between November 1 and March 31 when a resident is over the age of 65. Limiters are also not supposed to be used during that time frame. However, municipally-owned electric utilities like the one in Bay City, are not regulated by the state. The Michigan state attorney general’s office has launched an investigation into the incident.

Residents around Schur’s home say he was hard of hearing, and the city states that the device’s function and operation were never explained to him. When word of the story got around, people from all over the United States began to call the city in anger.

“I’ve taken calls from Canada, Massachusetts, Texas, New York, Alabama – and that’s just the ones I can think of off the top of my head,” said Melody Roth of the city’s administrative office, who also added that people from all over are “calling all city departments, not just our office.”

Schur has no known children, and his wife had died several years prior to the incident.

UK house prices have fallen 10.5% this year, says Nationwide Building Society

Category : Uncategorized

Thursday, August 28, 2008

After dropping 1.9% in July, house prices in the United Kingdom are now falling at the fastest rate since 1990, according to Nationwide Building Society.

The average price of a home has dropped by £20,000 down to £164,654, losing 10.5% of its value in 2008. Property values fell by 1.9% in the past month, and 1.5% in July. In another study, it was revealed that house prices have been steadily falling since October last year.

Nationwide’s chief economist, Fionnuala Earley said that activities in the housing market had recently been “very subdued”, although there are signs of increased interests in home sales, possibly due to the appeal of lower house prices.

The Bank of England stated there has been an increase in the number of people taking out a fixed rate mortgage as opposed to a variable rate loan. Further research by Nationwide has concluded that mortgage approvals also fell by 65% last month.

Landscaping With Shrubs: Some Tips

By Mr.Andrew Caxton

Off all elements that you can place in your landscape, from flowers to plants to trees, the shrub is the most versatile. In this article we present information on shrubbery.

When you consider your landscape, you’ll find that shrubs are one of the most versatile elements that you can employ. Shrubs can serve as a background for your flower or vegetable garden, as dividers between different areas of the yard, and even as privacy screens (otherwise known as hedges).

Shrubs come in a wide variety – over a hundred different genuses, with a variety of species within each genus: There are shrubs with brilliant flowers, or evergreen shrubs for all seasons.

What exactly are shrubs? According to the dictionary definition: “A woody plant of relatively low height, having several stems arising from the base and lacking a single trunk; a bush.” A rose bush is a shrub, for example, but so is a flowering dogwood. Have you heard that a dogwood is a tree? Well, some dogwoods are shrubs, and some are trees! Just as some lilacs are shrubs and some are trees. It all depends on how tall the individual species within the genus grows.

So there’s quite a bit to learn about shrubbery before you decide on which ones you’ll use in your landscaping endeavors. It’s always best to consult with your local gardening experts while you’re working on your design.

Website Wandering

But even though you’ll want to talk to local gardeners about what would be best for your landscaping plans, you don’t need to deal locally to acquire the shrubs. (Although it’s always nice to support local businesses.) And you will find that there are restrictions – some states do not allow you to import certain plants – Hawaii and Alaska are simply too far away.

But take a jaunt around the web to see what’s out there.

For example Direct Gardening offers everything from bulbs to fruits and nuts to hedges to shrubs to vines and water plants. Their website has plenty of photos of all their offerings so you can see what everything looks like. (They also sell what they call “Pre-planned gardens” – a mixture of several different but complimentary plants that will all grow well in the same type of conditions.)

Nature Hills Nursery is another online business that offers a wide variety of starter plants. And their website has a feature in which you input your zipcode, and it comes back with the “zone” in which you live – and the flowers, plants, shrubs and trees that grow best in that zone.

Pruning

The major maintenance for shrubs is pruning – you simply must prune your shrubs, not only to improve their appearance but also to help them grow healthy and strong. Hedge clippers and hand pruners are must have tools, loppers and a small pruning saw will also come in handy.

Astronomers discover largest star on record

Category : Uncategorized

Wednesday, July 21, 2010

European astronomers have discovered the most massive star yet on record; it is approximately 300 times the mass of our sun, beyond the previously accepted limit of 150 solar masses.

Paul Crowther, professor of astrophysics at the University of Sheffield, led the team of researchers that discovered the star. The team used the Very Large Telescope (VLT) in Chile, and data archived from the Hubble Space Telescope. The newly discovered star, designated R136a1, was discovered in the R136 star cluster.

The researchers estimate that the current mass of the star is about 265 solar masses, and could have been about 320 solar masses just after its birth.

“Unlike humans,” says Crowther, “these stars are born heavy and lose weight as they age. Being a little over a million years old, the most extreme star R136a1 is already middle-aged, and has undergone an intense weight loss programme, shedding a fifth of its initial mass over that time, or more than 50 solar masses.”

Astronomers not involved in the discovery, while still impressed, warn of the small possibility that the team could have mistaken two relatively close stars for one large one.

“What they’re characterizing as a single massive star,” Mark Krumholz told the Associated Press, “could in fact be a binary system too close to be resolved.” Krumholz is an astronomer at the University of California.

Another astronomer, Phillip Massey from the Lowell Observatory in Arizona, also warns that this may be the case. Massey explained that the star’s weight had been inferred using scientific models that were subject to change.

The R136 star cluster, the star’s location, is in the Tarantula Nebula in the Large Magellanic Cloud, a neighboring galaxy about 165,000 light-years away. The Large Magellanic Cloud, located between the constellations Dorado and Mensa, is visible as a faint cloud in the southern hemisphere. Astronomers are still struggling to understand how these stars form.

“Either they were born so big or smaller stars merged together to produce them,” Crowther explained. The researchers believe that the stellar heavyweight record could be held by this star for quite some time. Crowther elaborates: “Owing to the rarity of these monsters, I think it is unlikely that this new record will be broken any time soon.”
